Our 5-Step Income Tax Appeal Procedure

Order review in Mumbai

The work starts with the assessment order, the notice of demand and the assessment record, reviewed at the Ghatkopar West office in Mumbai or online. The team lists each addition, the time limit for appeal and the documents that support the company's position.

Appeal decision and grounds

For each addition, the team sets out the facts, the law and the case law on both sides, and recommends whether to appeal. Grounds of appeal and a statement of facts are then drafted and approved by the company's management.

Filing and demand

The appeal is filed online with its enclosures and the acknowledgement is shared. Separately, the team advises on the outstanding demand, including any application for a stay while the appeal is pending, under the guidelines the department follows, and on the payment that a stay usually requires.

Submissions and hearings

Written submissions, paper books and replies to any remand report are prepared for each hearing. The authorised representative attends hearings, online or in person, and records what was argued, what the authority asked for and what must be filed before the next date.

Order and next steps for Mumbai companies

When the appellate order arrives, the Mumbai team reads it against the grounds filed and the submissions made. It then explains to the company the relief on each ground, the tax effect and whether a further appeal is open, with its time limit.

Discuss Your Order

Appeal or not

When an Income Tax Appeal Makes Sense, and When It Does Not

A small addition where the facts are clearly against the company may cost more in management time than the tax involved, and rectification of an apparent mistake can be a faster route. Where the Assessing Officer proposes a variation for a company with a transfer pricing adjustment, or for a foreign company, a draft order comes first, and the company can object before the Dispute Resolution Panel within 30 days instead of filing a first appeal. An appeal is worth considering when the addition is large, when the same issue will recur in later years, or when the order rests on a reading of the facts or the law that the record can answer. HSAG Consulting discusses this trade-off with the company first.

FAQs on Hiring an Income Tax Appeal Consultant in Mumbai

What is an income tax appeal?

An income tax appeal is a formal challenge to an order of the income tax authorities, usually an assessment, reassessment or penalty order. The first appeal goes to the Commissioner of Income-tax (Appeals) or, for some orders, the Joint Commissioner (Appeals). A second appeal lies to the Income Tax Appellate Tribunal, after which a substantial question of law can go to the Bombay High Court.

Who can represent our company in an income tax appeal in Mumbai?

HSAG Consulting is one option in Mumbai: its direct tax team represents companies in assessments and appeals, with a chartered accountant acting as the authorised representative. Other options are a tax advocate, a sole-practice chartered accountant or tax specialist firms such as Dhruva Advisors. Check their record on the issue in dispute and who attends hearings.

How do you file an appeal in income tax against an assessment order?

The first appeal is filed online, with grounds and a statement of facts, within 30 days of service of the notice of demand. It is filed in Form 35 for years under the Income-tax Act, 1961, and in Form 99 for tax years under the Income-tax Act, 2025. The tax due on the income returned must be paid before the appeal is admitted (section 249(4) of the 1961 Act; section 358(6) of the 2025 Act).

How long does a company have to appeal to the ITAT?

Either the company or the department can appeal to the Income Tax Appellate Tribunal against the order of the Commissioner (Appeals) within two months from the end of the month in which that order is communicated. The bench hears both sides, and its findings on facts are final, so the factual record has to be complete at this stage.

Do we have to pay the disputed tax during an income tax appeal?

Not always in full. The demand remains payable while the appeal is pending unless a stay is granted. The Assessing Officer can grant a stay of demand, often on payment of a part of the disputed amount under the department's guidelines, and the stay is applied for separately from the appeal.

Who can appear before the ITAT for a company?

A company can appear through an authorised representative under section 288 of the Income-tax Act, 1961 (section 515 of the Income-tax Act, 2025). The representative can be a chartered accountant in practice, a legal practitioner or a regular employee, authorised in writing by the company. Before the Bombay High Court, a company is normally represented by an advocate.

What documents does an income tax appeal consultant in Mumbai need?

The consultant needs the assessment order, the notice of demand, the notices and replies from the assessment, the return and audited accounts for the year, and the evidence behind each disputed addition, such as contracts, invoices, bank statements and confirmations. Gaps in this record are hard to fill at the appeal stage.

What if the time limit for an income tax appeal has passed?

A late appeal can still be filed with an application for condonation of delay that explains why it was not filed in time. The Commissioner (Appeals) or the ITAT may admit it if satisfied that there was sufficient cause, so the reasons and the papers behind them matter. Filing as soon as the cause of the delay ends strengthens the request.
